The terms you're agreeing to when you buy from this site. They're written to be read rather than skipped, so they're shorter than most.

Who you're buying from

This shop is run by Deanna Wegenkittl-Baker, who paints the work, makes the prints, packs the parcels and answers the email. “We” below is a figure of speech; it is one person.

Prices

Every price is in Canadian dollars and is the whole amount you pay. Shipping is built into it rather than added at the end, and no tax is charged — this shop is under the CRA small-supplier threshold and is not GST/HST registered. The figure in your basket is the figure on your card.

Prices can change, but never for an order already placed. If registration for GST/HST becomes required, tax will start appearing as its own line at checkout rather than being folded silently into the price.

Orders

An order is accepted when payment goes through and you get a confirmation email. Until then nothing is reserved.

Very occasionally an order can’t be honoured — an original sold in the same hour, or a listing carried a genuine error in price or description. In that case the order is cancelled and refunded in full, promptly, with an explanation. Nobody is held to an obvious mistake, in either direction.

Prints

Prints are made to order with archival Epson inks, on one of two substrates. Smooth Matte is Epson Enhanced Matte paper; Canvas is archival 100% cotton canvas made in North America, cured and then machine-coated with a UV-protecting liquid laminate. They ship unframed and unmounted, rolled in a rigid tube. Orders typically ship within 1–3 weeks, and you get a tracking number by email once yours is on its way.

Sizes are listed as height × width, following each piece’s own orientation, so a portrait painting is never offered in landscape dimensions.

A print is a photograph of a physical painting, and no screen shows it exactly. Colour and surface will differ a little from what your monitor or phone renders, and that difference is not a defect. If the piece that arrives genuinely isn’t what you expected, that is what the returns policy is for.

Original paintings

There is one of each, and it is sold as final. Ask as many questions as you like before committing — more photographs, detail shots, how it reads in different light. A piece that arrives damaged is a different matter entirely and is handled like any other damaged delivery.

Shipping

Orders ship within Canada only. Canada is the only country offered at checkout, so an order cannot accidentally be placed from elsewhere. If you’re outside Canada and want something, send a note through the inquiry form and something can usually be worked out directly.

Risk passes to you on delivery, not on dispatch — if it is damaged in transit, that is ours to put right.

Returns

Prints can be returned within 14 days of delivery; originals are final. The full terms, including who pays return postage, are on the returns page.

Copyright

This is the part most worth reading. Deanna Wegenkittl-Baker retains copyright in every painting, every print, and every photograph on this site. Buying a piece transfers the physical object and nothing else.

So a purchase does not carry the right to:

  • reproduce the work, in print or digitally
  • sell copies, prints, or derivative versions of it
  • use it commercially — in branding, packaging, or a product
  • train a machine-learning model on it

Hanging it, photographing it in your own home, and posting that photograph is all entirely welcome. A credit is appreciated and never required. If you want to use an image for something beyond that, ask — permission is often granted, and costs nothing to request.

Commissions

Commissions are arranged individually and aren’t bought through this site. Scale, timeline, deposit and delivery are agreed in writing before any painting starts, and those terms govern the commission rather than this page. Start with the inquiry form.

Liability

If something goes wrong with an order, the remedy is the order: a replacement or a refund of what you paid. Beyond that, liability for indirect or consequential loss is excluded as far as the law allows.

Nothing here removes the consumer protections you have under British Columbia or Canadian law. Where a term conflicts with those rights, the law wins and the rest of this page still stands.

Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there.

Changes

These terms can change, and the date at the top says when they last did. The version in force for your order is the one published when you placed it.
